Business & Occupation Tax
The City of Clarksburg has business and occupation tax charged on gross revenues of every entity conducting business within the corporate limits of this municipality. The rate, per $100.00 of gross revenue, varies by business classification. This tax is required to be reported quarterly and is due on or before 30 days from the quarter ending. Returns postmarked after the due date are subject to penalties on the net tax due. **If no reportable activity ($0.00 gross income) occurred during the filing period, indicate on the Tax Return that there was no activity. Return by the due date to avoid delinquent notices and tax assessments.

Penalties
Penalties apply when a business does not timely report gross income on or before the due date. Penalty rates increase monthly or fraction thereof. The first month late has a 5% rate on the net tax due, each additional month late is an additional 1%.
Filing
Filing periods end on March 31, June 30, September 30, and December 31 unless other arrangements and permission has been granted by the Finance Director. Annual returns (residential rental ONLY) ends on December 31. These returns may be submitted by mail or in person. Each return MUST be submitted before any payment can be taken for taxes due. Accepted payment methods include cash, check (payable to City of Clarksburg), money order and credit/debit card (with processing fees).
Amended Returns
Amended returns are filed by completing the standard return form with the correct data. On the top of the form write “Amended Return”. Calculate the taxes and penalties as normal, and in the previous balance box enter any payment that was submitted with the original return. Amended returns MUST be completed in paper form. You are required to include a brief explanation of why you are submitting an Amended Return. If the Amended Return results in a credit to the business please indicate if you would like the amount left as a credit on your account or returned. If payment is returned provide name and address for a check to be sent.

(e) “Gross income” means the gross receipts of the taxpayer, other than a banking or financial business, received as compensation for personal services, and the gross receipts of the taxpayer derived from trade, business, commerce or sales and the value proceeding or accruing from the sale of tangible property, real or personal, or service, or both, and all receipts by reason of the investment of the capital of the business engaged in, including rentals, royalties, fees, reimbursed costs or expenses or other emoluments however designated and including all interest, carrying charges, fees or other like income, however denominated, derived by the taxpayer from repetitive carrying of accounts, in the regular course and conduct of his business, and extension of credit in connection with the sale of any tangible personal property or service, and without any deductions on account of the cost of property sold, the cost of materials used, labor costs, taxes, royalties paid in cash or in kind or otherwise, interest or discount paid or any other expense whatsoever. “Gross income” of a banking or financial business is specified in Section 745.33.
